The City maintains a constant inventory of available land, both developed and developable, to ensure businesses can find properties that meet their needs.

Request for Decision Summary
The purpose of this report is to seek first reading of Bylaw C-1099-19, a road closure bylaw that will close a 0.5 ha portion of surplus Oswald Drive right-of-way. The closure area would be sold to the adjacent owner for consolidation into their future industrial development.

Proposed Motion
That first reading be given to Bylaw C-1099-19, Road Closure - Portion of Oswald Drive.
A 0.5 ha area of undeveloped road right-of-way, identified as future Oswald Drive, is proposed for closure. The area is adjacent to 17 Golden Spike Road and was created with the subdivision of Lot 1, Plan 002 0866. This road right-of-way was created to provide access to both Lot 1, Plan 002 0866 and future development/subdivision within the SE 33-52-27-4.

The proposed subdivision and development of Lot 1, Plan 002 0866 will gain access to an internal subdivision road from Oswald Drive, but it has been determined that future development to the south (SE 33-52-27-4) will be permitted to have an additional access onto Golden Spike Road, as illustrated on the attached ASP Overview map. With future access to SE 33-52-27-4 identified directly from Golden Spike Road, the need for the extension of the Oswald Drive service road south of the access into Lot 1, Plan 002 0866 is removed. The closure area would be consolidated with Lot 1, Plan 002 0866 and become part of the developable land used in the subdivision and future development.

A subdivision application (2019-SG-07) has been submitted concurrently with this road closure bylaw. If this bylaw is approved, the excess road will be sold to the owner of Lot 1, Plan 002 0866 prior to consolidation and registration of the associated subdivision.
This proposal is for first reading only. Council may discuss and recommend changes at second reading. Alternatively, Council may choose to not give consideration to this bylaw by defeating the motion for first reading. 
A public hearing will be scheduled prior to second reading of this bylaw.

The proposed road closure has been circulated to internal departments and external agencies for their review and comment.
Once third reading is approved, the road closure bylaw would have to be registered at Land Titles before the road is legally closed. The consolidation and registration of this closure would be conditions of the 2019-SG-07 subdivision approval.
Approval of this bylaw would enable the sale of a portion of surplus road right-of-way for industrial development.
