Request for Decision Summary
Administration is seeking Council's approval of third reading of the Development Fees and Fines Bylaw. The proposed bylaw will repeal and replace the existing Development Fees and Fines Bylaw in order to add proposed performance damage deposit fees in the Engineering Fees section of the bylaw, as well as make minor amendments to terminology to align with the Surface Drainage Bylaw. The proposed bylaw will add two new development permit processing fees relating to cannabis sales and cannabis production uses. A fee is also being added for transfer of safety codes permits and building permits between owners, which is occurring more often with the increase in bankruptcies in the construction industry.
Proposed Motion
That third reading be given to Bylaw C-1046-18 - Development Fees and Fines Bylaw.
The Development Fees and Fines Bylaw establishes the various fees and fines related to planning processes, development permits, building permits, engineering processes and business licences.  Both the business licence fees and safety code permit fees were consolidated into the bylaw in 2011 from their respective process bylaws. Additional amendments were made in 2016 to incorporate enforcement fines from other bylaws into the Development Fees and Fines Bylaw.

The proposed amendment adds the following fees to the Development Fees and Fines Bylaw:

  • New cannabis production facility or cannabis sales development  $760 + $1.30 per square meter
  • Change of occupancy or use - Cannabis sales or cannabis production facility $757.50
  • Transfer of permit to new owner $125
  • Transfer of permit to new owner $125
  • Performance Damage Agreement - Residential Lots $2500.00
  • Performance Damage Agreement – Commercial/Multi-Family Lots $5000.00
The Development Permit fees related to cannabis uses reflect new use types and the cost to process these permits. The permits are a higher cost than similar development permit processes due to the specific mapping requirements and additional review requirements associated with the uses, necessitating the fee proposal.

In accordance with the Surface Drainage Bylaw C-1045-18, Engineering has introduced a Performance Damage Agreement deposit to ensure that potential damages to City infrastructure during construction by builders are addressed. This will ensure that any damages are not passed on to City taxpayers but instead will be paid for by the person(s) who have caused the damage.

The two additional fees for permit transfer reflect a growing need for the ability to transfer permits between owners in the situation of bankruptcies, which saves new owners from having to start a permit process from the beginning. This fee covers the review by administration of the appropriateness of the request and the transfer of the permit.
Council may direct administration to change the amount of the proposed fees.
No consultation is necessary or required for this bylaw.  The Municipal Government Act does not require a public hearing to adopt or amend this bylaw.
If approved, the Development Fees and Fines Bylaw will be updated on the City's website.
The fines outlined in the Development Fees and Fines Bylaw are needed to cover costs associated with new services and new use types.
