Request for Decision Summary
This Request for Decision seeks Council's approval for third reading of Bylaw C-1029-18, as amended, that considers a Land Use Bylaw amendment proposing to redistrict land within the North Central Area Structure Plan from UR - Urban Reserve District to R1 - Low to Medium Density Residential District. (see Attachment A)

At the applicant's request, this Bylaw C-1029-18 has been amended from its presentation at second reading to include a portion of Calahoo Road and a small area of R1 District lands (see Attachment B).  These added lands were considered under Bylaw C-1023-17, which also has second reading, and this Bylaw will have to similarly be changed in the future to remove these areas (i.e. road & small residential area) to accommodate this amendment.  

Administration supports this bylaw, as amended.  This amendment would allow for the subdivision of single detached residential dwellings. A signed development required for third reading has been received.

Proposed Motion
That third reading be given to Bylaw C-1029-18 - Land Use Bylaw Amendment - Jesperdale Stage 11, as amended.

Select Engineering, on behalf of the landowner, has made a Land Use Bylaw Amendment application for lands located within the North Central Area Structure Plan (ASP) area (see Attachment C).  The application, referenced as Jesperdale Stage 11, proposes amending 2.04 ha of Plan 062-6301, Block 23, Lot 1, from UR - Urban Reserve District to R1 – Mixed Low to Medium Density Residential District.  The landowner plans 34 parcels for single detached residential dwellings.

At the request of the landowner, Bylaw C-1029-18 has been revised from second reading to now include an abutting part of Calahoo Road and a small R1 District area intended for adding three (3) additional parcels. These lands come out of the abutting Bylaw C-1023-17 Jesperdale Stages 8 and 10, which will also be amended at that bylaw's third reading.  As both bylaws changing to accommodate this amendment are at second reading, and have previously had public hearings, the City's solicitor has confirmed that there is no need to hold a further public hearing.  The reasons for this are: there was no opposition at the public hearings previously held; the overall layout and density are not changing; and, if someone had previously had an interest in either of these redistricting bylaws they would anticipate the ultimate arrangement for adding these three (3) parcels, so its being in one bylaw rather than the other bylaw would not trigger the need of a further public hearing.

The development agreement has been signed and the bylaw, as amended, may now be considered for third reading per Corporate Policy No.: 7,005 Information Requirements for Redistricting Bylaws. 

Your Bright Future - Municipal Development Plan, 2010 – 2020 (MDP) - the MDP is the City’s primary statutory plan land use planning, and in its Figure 8 - Future Land Use map the subject lands are indicated for Residential land use.  This proposed Bylaw amendment is consistent with the MDP’s land use intent.

Area Structure Plan (ASP) - The North Central Area Structure Plan (ASP), Bylaw C-477-03 adopted in May 2003, defines intended land uses for the subject lands on its Land Use Concept as Mixed Low to Medium Density Residential (see Attachment D).  This Bylaw proposes land use districting consistent with the ASP's intended future land use.

Land Use Bylaw - All subject lands are districted UR – Urban Reserve in Land Use Bylaw (C-824-12), and a reclassification to an appropriate land use district(s) is normally required prior to subdivision and development.  This Jesperdale Stage 11 area amendment proposes R1 – Mixed Low to Medium Density Residential District that can accommodate a range of low to medium density residential dwelling types that includes Semi-Detached and Single Detached Dwellings as permitted uses. The Proposed R1 District is consistent with the City's MDP and North Central ASP.

A statutory public hearing was advertised and held on March 12, 2018, per the requirements of the Municipal Government Act.  No comments were received.
If approved, the Land Use Bylaw map will be updated and posted on the City's website.
This amendment will allow for the subdivision of parcels for single detached residential housing.
