Request for Decision Summary
Second and third reading of Bylaw C-1117-20 - Off-site Levy Bylaw, are being brought forward for Council's consideration. This bylaw is intended to replace Bylaw C-1078-19, and will set the updated 2020 off-site levy rates. 

Proposed Motion
That second reading be given to Bylaw C-1117-20 Off-Site Levy Bylaw, as amended.
 
That third reading be given to Bylaw C-1117-20 Off-Site Levy Bylaw.
Background/Analysis
As per the existing Off-site Levy Bylaw (C-1078-19), the City shall conduct an annual review of Off-site Levy rates. City Engineering, Planning, and Finance departments have updated the rates for 2020 utilizing the CORVUS model. The 2020 Off-site Levy Report and the existing 2019 Bylaw C-1078-19 are attached for review.

Based on feedback received from UDI and consultation with City of Spruce Grove legal counsel and CORVUS Business Advisors, updates to the Off-site Levy model were completed after first reading resulting in adjustments to the final rates.  These changes are documented in the attached Schedule B, and summarized as follows:
  • Water reserve balance - adjusted from ($1,411,995.60) to ($2,414,396.59).  
  • Allocation of Sanitary Off-Site Infrastructure to Benefiting Parties has been adjusted to assign a portion of Pioneer Sanitary Trunk sewer costs to other stakeholders (future annexation lands south of Highway 16a)
  • Sanitary Adjusted Developer Cost has been reduced from $14,566,519 to $11,649,695 based on the adjusted Pioneer Trunk sanitary allocation above.
  • Sanitary reserve balance  - adjusted from ($7,597,300.91) to ($8,084,811.67).
  • Updated Transportation Residual Developer costs from $58.61m to $63.76m after adjusting financial oversizing calculation.
  • Adjusted allocation of transportation project 48 to benefit all Off-site levy areas.
  • Adjusted Summary of Off-Site Levy Rates and associated charts.
Options/Alternatives
Council may choose to not give second and third reading to this bylaw.  If this option is chosen, existing Off-site levy rates would remain in place.
Consultation/Engagement
This Bylaw was developed as a result of the cooperation between Planning, Engineering and Finance. Urban Development Institute has reviewed the 2020 report and the model and rates were adjusted by City administration in response to their questions and concerns.

Impacts
The 2020 Off-site Levy Bylaw will provide fair rates and a solid methodology to support the program, utilizing the CORVUS model, within the guidelines of the Municipal Government Act.
