Request for Decision Summary
First reading of C-1104-19 - 2019 Land Use Bylaw Review Amendments is proposed for Council's consideration. This bylaw is the annual update of C-824-12 - Land Use Bylaw which is undertaken to make minor technical adjustments and provide clarity to existing definitions and regulations.

Proposed Motion
That first reading be given to C-1104-19 - 2019 Land Use Bylaw Review Amendments.
Background/Analysis
C-824-12 - Land Use Bylaw was adopted in late 2012 and implemented on January 1, 2013. In order to improve this regulatory document, the Planning and Development department undertakes an annual review of the bylaw. The purpose of this update is to fine tune regulations, provide enhanced clarity, and fix inconsistencies.

The attached chart, Annual Review, 2019 Proposed Amendments Tracking Chart, itemizes all of the proposed amendments and provides the rationale for each proposed change. The amendments address:
  • new defined uses for Assisted Living Facility, Designated Assisted Living Facility, and new definitions for Construction Completion Certificate, Impermeable Materials and Turfgrass;
  • enhanced discretionary powers for Development Officers respecting industrial uses that deal with hazardous materials;
  • clear regulations respecting landscaping on low density developments;
  • amended regulations respecting landscaping on City owned boulevards consistent with other municipal bylaws; and
  • amending the height regulations in the R2 Mixed Medium to High Density Residential district by increasing the height of Four Storey developments from 14.0 to 15.0 m, and making the height provisions consistent for all uses within the district.
Options/Alternatives
This bylaw is being brought forward for first reading only. Discussion and consideration of changes to the bylaw may be made at second reading, which may occur after a public hearing is held on the matter.  Alternatively, Council may defeat the motion for first reading and choose not to give consideration to this bylaw.
Consultation/Engagement
The Spruce Grove Chapter of the Urban Development Institute (UDI) were circulated a draft bylaw amendment and their comments were incorporated into this proposed bylaw amendment. 

A statutory public hearing will be held prior to second reading and it will be advertised per the requirements of the Municipal Government Act
Implementation/Communication
Upon third reading of this bylaw, the amendments will be consolidated into the C-824-12 - Land Use Bylaw and posted on the City's website.
Impacts
The amendments will enhance and clarify the definitions and regulations to allow the development community and staff to better utilize the City's Land Use Bylaw.
