Request for Decision Summary
Corporate Policy CP-1017-19 is being brought forward for Council's approval. The purpose of this policy is to prohibit the provision or use of municipal resources for practice or promotion of conversion therapy.
That Policy CP-1017-19, Prohibition on the Use of Municipal Resources for Conversion Therapy be approved.
A notice of motion was brought forward at the regular meeting of Council on July 15, 2019 regarding Conversion Therapy in Spruce Grove. Subsequently, a motion was passed on August 12, 2019 that:
The report was presented at the Regular Council Meeting on October 15, 2019 and Council passed the following motion:
Administration research and prepare a report back to Council by October 15, 2019 regarding the potential to ban the practice of Conversion Therapy in Spruce Grove.
Based on Council's Direction, Policy CP-1017-19, Prohibition on the Use of Municipal Resources for Conversion Therapy was developed and is presented for approval. Administration prepare a Corporate Policy opposing the practice of Conversion Therapy and restricting the use of City resources and funding to organizations that practice and promote conversion therapy.
Definition of Conversion Therapy
Conversion therapy in this bylaw is defined as:
Any practice, treatment, or service designed to change or convert an individual’s sexual orientation, gender identity or gender expression. This does not include treatment by a Medical Professional that:
explores aspects of an individual’s sexual orientation, gender identity and gender expression; or
supports age or developmental-level-appropriate use of gender transition to align an individual’s biological and anatomical features with the individual’s gender identity.
Prohibition of Municipal Resources
A clear definition of municipal resources was required to support the prohibition on their use for the direct or indirect promotion or practice of conversion therapy. For the purposes of this policy, municipal resources are defined to include financial resources, in-kind resources, and City facilities. Financial resources are any monetary exchange such as sponsorships, grants, or consultant contracts. In-kind resources are provided free of charge to support organizations, groups, or activities including staff time and materials. Facilities are any building that is owned or operated by the City.
This policy also prohibits City advertising or the City logo to appear in any place that may indicate support for the practice of conversion therapy. When the logo is used in third-party advertising the City will take steps for the logo to be removed.
Council may recommend amendments to the proposed policy by making the following motion:
That Policy CP-1017-19, Prohibition on the Use of Municipal Resources for Conversion Therapy be referred back to Administration for revision.
Internal stakeholders were consulted in the development of the policy including Protective Services, Planning and Development, Communications, City Clerk, and Corporate Leadership Team. This policy was also reviewed by legal counsel.
The policy will be posted on the City website, once approved. City employees with responsibilities related to the allocation of municipal resources will be made aware of the policy and procedures may need to be updated/created to align with the policy. Support will be offered to staff to adjust their procedures to align with this policy.
