Request for Decision Summary
Bylaw C-1134-20 is part of the revised mobile vending strategy for the City, and is being brought forward for Council's consideration. This bylaw amends Schedule A of Bylaw C-1046-18. The purpose is to add fees for Mobile Vending Business Licence types and Street Vending Permits to the Development Fees and Fines Bylaw.

Proposed Motion
That first reading be given to Bylaw C-1134-20 Development Fees and Fines Bylaw Amendment.
Background/Analysis
Planning and Development has worked with Enforcement Services and Recreation Services to evaluate regulatory and enforcement options regarding food trucks and other mobile vendors. Through evaluation of our existing bylaws and practices in other municipalities, a strategy has been developed to make approvals for these uses easier and to address a variety of identified issues and concerns from both internal and external clients.

An amended schedule has been prepared for the Development Fees and Fines Bylaw to introduce fees for:
  • the Mobile Vendor Business Licence type;
  • the Mobile Vending Permit (through the Traffic Bylaw); and 
  • to introduce fines for Non-compliance with conditions of a Business Licence.

This bylaw works together with proposed C-1133-20 - Land Use Bylaw Amendment - Mobile Vending Bylaw and C-1135-20 - Business Licence Bylaw Amendment  to support the new mobile vending strategy.
Options/Alternatives
This bylaw is being brought forward for first reading. Discussion and consideration of changes to the bylaw may be made at second reading. Alternatively, Council may defeat the motion for first reading and choose to defeat this bylaw. 

If Council does not approve Bylaw C-1133-20 Land Use Bylaw Amendment - Mobile Vending, then amending Bylaw C-1134-20 would not be required.
Consultation/Engagement
Planning and Development has worked with Enforcement Services and Recreation Services to evaluate options regarding food trucks and other mobile vendors. Through review of existing bylaws and practices in other municipalities, a strategy has been drafted to address the following:
  • Clarity regarding mobile vending regulations on private property;
  • Enforceability - Enforcement needs to be able to enforce if needed;
  • Approvals need to be prompt;
  • Safety standards need to be satisfied;
  • Policy for use of public land;
  • Policy for use of road right-of-way; and
  • Establishment of appropriate fees.
Implementation/Communication
Subsequent readings of the proposed Bylaw C-1134-20 will be presented concurrently with the other bylaws associated with the mobile vending strategy, Bylaw C-1133-20 - Land Use Bylaw Amendment - Mobile Vending and Bylaw C-1135-20 Business Licence Bylaw Amendment. 

Following the approval of all three bylaws associated with the mobile vending strategy, a communication guide will be created by Planning and Development that will outline the process for mobile vending approval and the regulations that apply. 
Impacts
This bylaw will introduce a fee for mobile vending business licences and street vending permits.
