Request for Decision Summary
A public hearing is required to hear from anyone who may be affected by Bylaw C-1133-20. 

Bylaw C-1133-20 is part of the proposed Mobile Vending strategy for the City. This amendment would remove the development permit requirement for mobile vendors under certain conditions. This change will reduce approval timelines by eliminating the administrative review and approval process, and the required appeal period for a development permit. The amendment also introduces specific regulations and requirements for mobile vendors operating on private property.

Administration supports Bylaw C-1133-20.

Background/Analysis
The City has had numerous requests for food trucks over the past few years and the problems encountered are often related to the timing of approvals. For locations on private properties all mobile vendors are currently considered a discretionary use or development and are required to attain a development permit under the Land Use Bylaw. As the development permit approval process includes an appeal period, even if the development authority could turn around a decision in one day, the official approval cannot be issued until after the close of the appeal period of 21 days. To alleviate the appeal delay in approval, this amendment to the Land Use Bylaw identifies that mobile vending, within specific criteria, does not require a development permit.

Options/Alternatives
Bylaw C-1133-20 is being presented for Council's consideration of second reading later on this same Council agenda. Should Council feel they need further information to make a decision they may choose to adjourn the public hearing for continuance at a later date. If Council chooses this option, second reading of this bylaw will be re-scheduled.
Consultation/Engagement
This public hearing was advertised in the December 24 and 31, 2020 editions of the Spruce Grove Examiner in accordance with the requirements of the Municipal Government Act. An additional notice was placed in the January 8, 2021 City Page of the Examiner.
Implementation/Communication
Following the statutory public hearing, second reading will be brought forward for consideration by Council. 
Impacts
This public hearing fulfills the statutory requirement under the Municipal Government Act to hear from those affected by the proposed amendment to the Land Use Bylaw. Information that is presented at this public hearing will inform Council's consideration of the bylaw at second reading.
