Request for Decision Summary
This Request for Decision seeks Council’s third reading of Bylaw C-1039-18, a Land Use Bylaw amendment application proposing to redistrict land from UR - Urban Reserve District to R1 - Mixed Low to Medium Density Residential District and P1 - Parks and Recreation District.    This amendment would allow subdivision for single-detached residential lots and park lands abutting the northeast boundary of Jubilee Park.  The boundary of this amendment has been reduced in size from what was presented at the previous Council readings and the public hearing.   

Administration supports this bylaw amendment with its reduced boundary.

Proposed Motion
That third reading be given to Bylaw C-1039-18 - Land Use Bylaw Amendment - Redistricting - Greenbury Stage 10, as amended.
IBI Group, on behalf of the landowner, has made a Land Use Bylaw Amendment application for lands within the Pioneer Lands Area Structure Plan.  The application, referenced as Greenbury Stage 10, proposes amending part of Plan 132-4055, Block A, Lot 2, from UR - Urban Reserve District to R1 – Mixed Low to Medium Density Residential District and P1 - Parks and Recreation District. 

In the time since second reading, the applicant has requested that this amendment be reduced to approximately half of its original size.  This request is for a simple boundary reduction for lands within the same boundary area, and the Planning Department accepts that the previous application review and public hearing remains adequate.   Planning and Development supports Bylaw C-1039-18 in its reduced size.

With the application reduction, the landowner now plans approximately 20 parcels (reduced from 41 parcels) for single detached residential dwellings and a natural area 'buffer' on the north side of Jubilee Park.

Municipal Development Plan (MDP) - Your Bright Future MDP 2010 – 2020 is the City’s primary statutory land use planning document. MDP Figure 8 - Future Land Use map defines the subject lands for Residential land use, and MDP Figure 6 - Parks and Open Space map identifies that this redistricting area abuts Natural Area J located within Jubilee Park.  MDP Policy requires that an assessment is required to understand how this proposal may adversely affect an environmentally significant area (i.e. Natural Area J). In consideration of the assessment's' recommendations and administration's review of it, a 5.0 metre open space 'buffer' was required on the land's interface with Natural Area J.  This proposed Bylaw amendment is consistent with the MDP's policy and intended land use.

Area Structure Plan (ASP) - The Pioneer Lands ASP, Bylaw C-686-08, as amended, defines intended land uses for the subject lands on Exhibit 3 – Development Concept.  This Bylaw amendment proposes land use districting consistent with the ASP's Mixed Low to Medium Density Residential designation.

Land Use Bylaw - All subject lands are districted UR – Urban Reserve in Land Use Bylaw (C-824-12), and a reclassification to appropriate land use districts is normally required prior to subdivision and development.  Greenbury Stage 10 area proposes R1 – Mixed Low to Medium Density Residential District, which includes Semi-Detached and Single Detached Dwellings as permitted uses, and P1 - Parks and Recreation District for providing an open space  'buffer' along the north side of Jubilee Park to protect Natural Area J.
The proposed amendment has been circulated internally for the comments of other municipal departments, and all concerns have been satisfactorily addressed. 

A public hearing for this Bylaw C-1039-18 was held on August 13, 2018, per the requirements of the Municipal Government Act
If approved, the Land Use Bylaw map will be updated and posted on the City's website.
This amendment will provide for development of low density residential dwellings and park space in the Greenbury neighbourhood.
