Title: Removal of Municipal Reserve Designation - Public Hearing - Part of Lot 1R, Block 1, Plan 782 3421 - Levasseur

Request for Decision Summary
The purpose of this report is to provide Council with background information to undertake the statutory public hearing on a proposed Removal of Municipal Reserve Designation from a part of Lot 1R, Block 1, Plan 782 3421, which is located north of Weston Drive and east of St. Joseph Catholic School.   The proposal is to remove the municipal reserve designation to allow subdivision and sale of the lands to the abutting landowner to correct for an encroachment into Heritage Grove Park. 

Administration supports this municipal reserve designation removal.

Proposed Motion
That those in attendance be thanked for their input.

The portion of municipal reserve Lot 1R, Block 1, Plan 782 3421, has certain encroachments into it from an abutting parcel.  To solve this encroachment matter administration is proposing to subdivide and sell a small portion of Heritage Grove Park to the abutting landowner.

Section 674 of the Municipal Government Act requires that if a council wishes to remove the municipal reserve designation from all or a portion of a MR parcel, a public hearing must be advertised and held in accordance with the Act.  Notice of this public hearing has been provided by advertisements in the Spruce Grove Examiner (December 28, 2018 and January 4, 2019 editions), by a notice sign placed on the subject site, and by a posting on the City's website.  Adjacent landowners were also provided written notice of the public hearing.
When Council, by motion, approves the removal of the municipal reserve designation, administration will complete the necessary documentation required by Land Titles at the time of the endorsement and registration of the subdivision.
The City will reduce the existing Heritage Grove Park by 0.033 hectares by land sale, and this action will correct an encroachment into the park lands from the abutting landowner.
