Request for Decision Summary
The purpose of this report is to seek Council's support for third reading of Bylaw C-1053-18 - Smoking Bylaw.

Proposed Motion
That third reading be given to Bylaw C-1053-18 - Smoking Bylaw, as amended.

Background/Analysis
As part of the legalization of cannabis and the regulations and proposed bylaw dealing with consumption, administration brought forward recommended amendments to the smoking bylaw. At the time of bringing it forward in June the only information administration had in regards to legalization was from the Federal Government's original position of "legalization by summer of 2018" which as we know has changed. Administration was attempting to get some reference to cannabis in relation to the smoking bylaw by the end of June. As mentioned, the official legalization of cannabis is now scheduled for Oct 17, 2018.

The extended deadline for cannabis legalization allowed administration to more thoroughly examine our existing smoking bylaw which required an update. The original bylaw was passed prior to Provincial regulations that came into effect in 2005. Additionally, many municipalities have been faced with examining their smoking bylaws in the context of cannabis but also as public opinion and public health has changed its outlook on smoking over the years.

The original smoking bylaw amendment brought forward to Council in June of 2018 will not be presented for third reading. The original proposed amendment simply added an exclusion of cannabis so as to not confuse it with our separate cannabis consumption bylaw. Not only has the recommendation changed in that regard but there have been far to many other updates made to the bylaw so administration presented a new bylaw at the September 24, 2018 Council meeting for first and second reading. The bylaw has been amended since first and second reading as per resolutions 236-18 and 237-18 passed on September 24, 2018.  In Section 4.1, Prohibitions, the distance has been updated from five (5) meters to ten (10) meters. Section 4.1(f), any City initiated event and associated areas, has been removed. A redline copy  is provided for your reference. This evening the bylaw is being presented to Council for third reading.
