Title:    C-1014-17 - Second and Third Readings - Road Closure - Portion of Road Plan 802 2789 - Levasseur

Request for Decision Summary
The purpose of this report is to seek Council's support for second and third readings of Bylaw C-1014-17 that would close a portion of public road right-of-way.  The proposed closure area is considered surplus road registered under Plan 802 2789,  on the north side of Highway 16A, for the one-half mile stretch west of Jennifer Heil Way.  The surplus road right-of-way is to be sold to the landowner to the north and be incorporated into the SE 5-53-24-W4M titled area.

Proposed Motion
That second reading be given to Bylaw C-1014-17 - Road Closure - Portion of Road Plan 802 2789.

That third reading be given to Bylaw C-1014-17 - Road Closure - Portion of Road Plan 802 2789.
It was determined that a 22.76 m wide portion of the road plan on the north side of Highway 16A, for the one-half mile stretch immediately west of Jennifer Heil Way, is considered surplus and not needed by the City for future highway widening.  The total surplus right-of-way is approximately 1.8 ha.

There is a previous road closure bylaw (Bylaw C-622-06) for this area that received third reading but has not been registered at Land Titles.  The Alberta Land Title requirements for registration of a road closure have changed since the approval of C-622-06; the former bylaw does not meet these revised requirements and is not registrable, therefore a new road closure bylaw is necessary.

The owner of the lands to the north is currently undertaking an update of the West Central Area Structure Plan with the intent of future sale and development of the lands. As such, it is now time to deal with this future surplus right-of-way and the City is negotiating with the landowner for the sale of the land. Under the existing ASP, the land immediately north of the proposed closure area is designated retail/commercial and it is anticipated that this land use designation will remain commercial under the updated ASP.
As per the requirements of Section 22(4) of the Municipal Government Act, a public hearing was held to provide those effected by the proposed closure, and the general public, an opportunity to be heard by Council.  Notice of the public hearing was advertised in the Spruce Grove Examiner and adjacent landowners were notified directly.
The closure and consolidation of the land with the lands to the north is an excellent example of efficient use of land.  As this highway right-of-way is considered surplus to City's future needs, the lands should be used for future commercial development.
