Information
Request for Decision Summary
The purpose of this report is to provide Council with background information on proposed Bylaw C-1011-17, Land Use Bylaw Text Amendment for 7 McLeod Avenue, in order to undertake the statutory public hearing. The bylaw proposes Child Care Facilities to be considered as a discretionary use on a site specific basis on Lot 120, Block 17, Plan 094 1759 (7 McLeod Avenue) in the C2 - Vehicle Oriented Commercial District.

Administration does not support the proposed site specific text amendment to the Land Use Bylaw and recommends that Council defeat the bylaw at second reading.

Background/Analysis
An amendment to the Land Use Bylaw has been received to add Child Care Facility as a discretionary use to the C2 – Vehicle Oriented Commercial District on a site specific basis (See Attachment A). This text amendment will allow for a Child Care Facility to be considered on Lot 120, Block 17, Plan 094 1759 (7 McLeod Avenue). If adopted, the use will allow for on-site care and supervision, but not overnight accommodation, to seven or more children under the age of thirteen.
 
The subject site is districted C2 – Vehicle Oriented Commercial District and is intended to provide commercial uses mainly serving vehicle traffic.

Consultation/Engagement
Administration has discussed initial comments about the proposed Land Use Bylaw text amendment and Administration's non-support with the applicant.

Public hearing notices were advertised in the local newspaper on August 25 and September 1, 2017 as per the Municipal Government Act requirements. The public hearing notice was also mailed to landowners adjacent to the plan area.
