 The Records and Information Management Bylaw is being amended to be consistent with and to support the implementation of the new Emergency Management Bylaw (C-957-16) currently being considered by Council . 

 

 
 
 
Proposed Motion
That first reading be given to Bylaw C-1017-17 - Records and Information Management Bylaw Amendment.

 That second reading be given to Bylaw C-1017-17 - Records and Information Management Bylaw Amendment.  

Background/Analysis
The Records and Information Management bylaw is being amended to be consistent with and support the Emergency Management Bylaw, C-957-16 currently being considered by Council.

Section 1.6, "Head of a Public Body" is being amended from its current definition that refers to the City Manager  as the Head to also include the Director Emergency Management with respect to the disclosure of personal information under the Freedom of Information and Protection of Privacy Act.

This change will set the Head of the Public Body as the Director Emergency Management for the purpose of determining if it is reasonable to disclose personal information that will avert or minimize a risk of harm to the health or safety of a minor, or an imminent danger to the health or safety of any person. This will apply at all times including during a state of local emergency.  

Both the Provincial and Federal Privacy Commissioners recognize this need and have stated that the privacy laws should not be considered a barrier to appropriate information sharing, nor should they be used as an excuse for inaction. As such Spruce Grove’s proposed new Emergency Management Bylaw addresses the release of information.  A legal opinion suggested that in addition to the wording within the proposed Emergency Management Bylaw the current Records and Information Management Bylaw should be amended to modify the definition of the “Head of a Public Body” to reflect this release of information authority.
