Request for Decision Summary
The purpose of this request for decision is to obtain first reading of Bylaw C-1078-19, Off-site Levy Bylaw.  This new bylaw is intended to replace Bylaw C-1040-18.  

Proposed Motion
That first reading be given to Bylaw C-1078-19 Off-site Levy Bylaw.
As per the existing Off-site Levy Bylaw (C-1040-18), the City shall conduct an annual review of Off-site Levy rates.  City Engineering, Planning, and Finance departments have updated the rates for 2019 utilizing the CORVUS model.  The 2019 Off-site Levy Report and Current Bylaw C-1040-18 are attached for review.

Following legal review, Administration incorporated the following changes into the draft off-site levy bylaw:
  • clarified the definition of Developable Lands and Developed Land;
  • clarified the requirement to pay an off-site levy is imposed in the Development Agreement;
  • clarified when payment of the off-site levy is to be paid;
  • authorized the General Manager of Planning and Development to make decisions regarding the contractual enforcement of the Development Agreement; and
  • updated references to other legislation.
This Bylaw was developed as a result of the cooperation between Planning, Engineering and Finance.  Urban Development Institute has been provided with, and is currently reviewing the 2019 report. 
The 2019 Off-site Levy Bylaw will provide fair rates and a solid methodology to support the program, utilizing the new model, within the guidelines of the Municipal Government Act.
