Request for Decision Summary
The purpose of this report is to seek Council's consideration of a resolution to remove the municipal reserve designation from a portion of a municipal reserve parcel. The reason for removing the municipal reserve designation from part of Lot 6MR, Block 1, Plan 162 3162, adjacent to the proposed school in the Copper Haven neighbourhood, is to sell the land to the Parkland School Division No. 70 for a school bus transfer facility.
Administration supports this municipal reserve disposition.
That the municipal reserve designation be removed from all that portion of Lot 6MR, Block 1, Plan 162 3162 that is shown as Lot 9, Block 1, Plan 172 _____ (as prepared by L. Chad Finner A.L.S. File: 2407SUB).
The portion of municipal reserve Lot 6MR that is the subject of this request, as shown as proposed Lot 9 on the attached tentative plan of subdivision is located adjacent to the proposed new school in the Copper Haven neighbourhood. Parkland School Division No. 70 has requested to purchase this area in order to construct a new school bus transfer station. This proposed use does not meet the use provisions allowed under the Municipal Government Act, so the municipal reserve designation must be removed prior to the sale of the land.
Existing Lot 6MR is proposed to be subdivided into three parcels; one parcel is to contain a new K to 9 school (proposed Lot 7MR), one parcel is to contain sports fields and a future catholic elementary school (proposed Lot 8MR) and the third is to contain the proposed bus transfer facility. Only the portion encompassed by Lot 9, containing 1.1 ha, is the subject of this request to remove the municipal reserve designation.
Pursuant to the requirements of Section 674 of the Municipal Government Act, Council held a public hearing on May 23, 2017 to remove the municipal reserve designation from a portion of a MR parcel. Notice of this public hearing was advertised in the Spruce Grove Examiner (May 5th and 12th) and posted on the City's website. Adjacent landowners were provided written notice of the public hearing and a notice was posted on the subject site in accordance with the requirements of the Act.
When Council, by motion, approves the removal of the municipal reserve designation, administration will complete the necessary documentation required by Land Titles at the time of the endorsement and registration of the subdivision.
For effective and efficient transportation of students, Parkland School Division has advised that an additional bus transfer facility is necessary. The School Division will be entering into an agreement with the City with respect to the purchase of these lands. Without the disposition of the MR designation, the City will be unable to meet the provisions of a sales agreement.
As estimated in the Corporate Plan, the revenue from the sale of the parcel to the Parkland School Division will be approximately $247,105 per ha ($100,000 per ac.) for a total of $271,816.
The actual final price will be determined by a certified land appraisal.
