Request for Decision Summary
This Request for Decision is to seek first reading of Bylaw C-1059-18, which proposes to redistrict a strip of land located within Heritage Grove Park from P1 - Park and Recreation District to RMHC - Manufactured Home Court District. 

The land subject to this amendment is approximately 0.033 hectare in area, and is part of Lot 1R, Block 1, Plan 782 3421.  This Bylaw will allow the subject lands to be subdivided, sold, and consolidated with the abutting Mobile City manufactured home court to correct an existing encroachment into the parkland. 

Administration supports this Bylaw.  

Proposed Motion
That first reading be given to Bylaw C-1059-18 - Land Use Bylaw Amendment - Heritage Grove Park South Redistricting.
Background/Analysis
Administration is proposing Bylaw C-1059-18 to amend the Land Use Bylaw for redistricting a small strip of land on the south of Heritage Grove Park from P1 - Parks and Recreation District to RMHC - Manufactured Home Court District.  This redistricting would allow for the subdivision and sale of these lands.  The land subject of this amendment comprises approximately 0.033 hectares, and is part of Lot 1R, Block 1, Plan 782 3421.

The subject lands are fenced, sodded, and being maintained as part of an existing manufactured home park unit located in the Mobile City Estates manufactured home court.  This manufactured home's west wall is more or less sited on the park's property line, and the building extensions that include a significant deck, part of which is covered, and concrete pads front and back are located within Heritage Grove Park.  The subject lands are bounded on the west by a ball-field within the parkland, to the north by a natural tree stand, and to the west and south by manufactured homes (see Attachment B).

This redistricting is desirable as buildings intended within the manufactured home court have been built on City parkland, and the sale of these lands would allow correction of this encroachment matter.

The sale of this parcel requires that Council remove the land's municipal reserve designation after a public hearing, and in accordance with Section 675 for the Municipal Government Act. The municipal reserve designation removal requires a resolution of Council, and that process is proceeding concurrently with this proposed Bylaw.
Options/Alternatives

Consultation/Engagement
Administration has discussed this resolution with the landowner, and has received the landowner's verbal support (i.e. Mobile City Estates), for this potential solution to this encroachment matter. The City will be looking for acceptance in writing prior to the public hearing and further readings. 

Public Hearing - A statutory public hearing will be held prior to second reading, and administration will inform surrounding landowners and advertise the public hearing per the requirements of the Municipal Government Act. Questions or comments regarding this redistricting will be addressed at the public hearing. 
Implementation/Communication
If approved, the changes to the Land Use Bylaw's Land Use District Map will be updated and posted on the City's website.
Impacts
This amendment will allow for the subdivision and sale of the subject lands to the abutting landowner, which will provide a solution to their buildings that currently encroach into Heritage Grove Park.
