Request for Decision Summary
The purpose of this agenda item is to re-appoint two public members to the Spruce Grove Public Library Board. It was moved by Councillor Rothe at the November 14, 2017 regular council meeting that Mr. Rudy Zacharias and Mr. Grant Crawford be re-appointed to the Spruce Grove Public Library Board and the motion was subsequently tabled to allow Administration to seek additional information.

Proposed Motion
To take from the table the motion relating to the Spruce Grove Public Library Board - Board Member Re-appointments.

A motion to take from the table is not debatable and requires a majority vote.

The main motion was moved by Councillor Rothe at the November 14, 2017 regular council meeting. The main motion, as stated below, will be brought forward for consideration once again if the motion to take from the table is carried.

Moved by Councillor Rothe that Rudy Zacharias and Grant Crawford be re-appointed as members of the Spruce Grove Library Board to each complete a term expiring December 31, 2020. 

Background/Analysis
During the November 14, 2017 Regular Council Meeting it was brought to the attention of both administration and Council that one of the proposed appointee’s to the Library Board was no longer a resident of Spruce Grove.  The motion to reappoint the recommended members was tabled in order for administration to research and clarify whether or not the candidate was eligible.
 
The City has an approved policy (#5,007) from 2002 which is the “Appointments to Council Boards, Commissions, and Committees” policy.  The policy clearly identifies residency requirements; however, in the preamble to the policy it states:
 
“This policy does not apply to Management Boards such as the Spruce Grove Library Board.”
 
Legislation, namely the Libraries Act, also allows for representation from an “area” vs. specific to a municipality.  Therefore, in light of this information there is no conflict with any proposed candidate being a member of the Library Board appointed by City Council.  At the same time, administration believes Council should be made aware of residency of the Board or potential Board members as additional information for consideration of appointments.  Ultimately, it is City Council’s representative and they can choose to appoint or not appoint at their discretion.  Administration has already had discussions with the Library Executive Director as to how this information can be provided in the future.
 
In this particular case, administration has no concerns at this time and supports the re-appointments as per the original motion on November 14, 2017 and the recommendation of the Library Board.
