Request for Decision Summary
Administration is seeking Council's approval to enter into an agreement to sell 0.033 hectares of land to W.J. Properties Inc. in order to rectify a residential encroachment onto City reserve property. The land in question is in Heritage Grove Park abutting Weston Drive and located east of St. Joseph Catholic School. 
Proposed Motion
That the City enter into an agreement with W.J. Properties Inc. to sell approximately 0.033 hectares of land, described as a portion of Lot 1R, Block 1, Plan 782 3421, for a price of $9,700.00. 

A portion of municipal reserve Lot 1R, Block 1, Plan 782 3421, which includes part of Heritage Grove Park, has certain encroachments onto it from an abutting parcel. The park lands are currently fenced, sodded, and being maintained as part of an existing manufactured home park unit located in the Mobile City Estates manufactured home court. The manufactured home in question has its west wall more or less located on the park's property line, with building extensions that include a significant covered deck and concrete pads, and is located within Heritage Grove Park. Nearly the entire property being sold by the City is affected by a right-of-way for an underground power line, which influences the value of the land. The City has received confirmation from Fortis that the appurtenances in the right-of-way can remain as is.

On January 14, 2019, Council approved the removal of reserve designation for the subject lands and also approved an amendment to the Land Use Bylaw to redistrict the lands for manufactured home use. To continue with the sale of the subject lands, administration must have authorization to sell the property. Two independent appraisals of the land were prepared by separate professional appraisers, which both came to similar land values. The average of the two appraisals results in a sale price of $9,700.00. If approved, the land sale agreement will be prepared and executed upon final subdivision of the land, which is to occur within 45 days of Council's action.
A draft Purchase Agreement has been negotiated with W.J. Properties Inc. pending approval of the transaction by City Council. 
The sale and transfer of lands will result in a reduction of liability to the City from the previously discussed manufactured home and accessory structure encroachments.

Fiscal Impact
Financial Implications:
The implementation of this proposal will result in revenue of $9,700, which must be earmarked for purchase of other Municipal Reserve lands per the Municipal Government Act.
