Request for Decision Summary

This Request for Decision seeks second reading of Bylaw C-1023-17 for two Land Use Bylaw amendment applications proposing land use district changes. These amendments are: Jesperdale Stage 8 that proposes to redistrict 1.61 ha from UR - Urban Reserve District to R1 - Mixed Low to Medium Density Residential District: and, Jesperdale Stage 10 that proposes to redistrict 5.29 ha from UR - Urban Reserve District to P1 - Parks and Recreation District.

Administration supports this this Bylaw amendment.  This amendment would allow subdividing parcels for single a semi-detached housing, and a stormwater management facility with open space and trails.  

Proposed Motion
That second reading be given to Bylaw C-1023-17- Land Use Bylaw Amendment - Redistricting - Jesperdale Stages 8 and 10.


Bylaw C-1023-17 replaces Bylaws C-984-16 and C-1006-17 that were cancelled due to no Council quorum remaining from the original public hearings.

Select Engineering, on behalf of the landowner, has made two adjacent Land Use Bylaw Amendment applications in the North Central ASP area.  The Jesperdale Stage 8 application proposes amending 1.61 ha of Plan 062-6301, Block 23, Lot 1, from UR - Urban Reserve District to R1 – Mixed Low to Medium Density Residential District, and the Jesperdale Stage 10 application proposes redistricting 5.29 ha of Plan 062-6301, Block 23, Lot 1, from UR - Urban Reserve District to P1 - Parks and Recreation District (See Attachment B).  The landowner plans three single detached and 28 semi-detached residential parcels (Jesperdale Stage 8), and the completion of the area stormwater management facility with associated trails and open space (Jesperdale Stage 10).

Municipal Development Plan:  Your Bright Future, Municipal Development Plan, 2010 – 2020 (MDP) on Figure 8 - Future Land Use map indicates the subject lands are for Residential and Open Space land uses, and the proposed Bylaw is consistent with this MDP intent.

North Central Area Structure Plan: The North Central ASP Bylaw C-477-03 defines on Figure 2 – Land Use Concept Mixed Low to Medium Density Residential, Park/Open Space, and Wetpond Facility land uses, and this proposed Bylaw conforms with this land use direction.

Land Use Bylaw:  All subject lands are districted UR – Urban Reserve in Land Use Bylaw (C-824-12), and a reclassification to an appropriate land use district(s) is normally required prior to subdivision and development.  The Jesperdale Stage 8 area proposes R1 – Mixed Low to Medium Density Residential District that can accommodate a range of low to medium density residential dwelling types that includes Semi-Detached and Single Detached Dwellings as permitted uses. The Jesperdale Stage 10 area proposes P1 – Parks and Recreational District that allows for development of public parks, recreational facilities, and Government Services. Reclassifying to the P1 District will allow for subdivision of a stormwater management facility parcel, and provide abutting open space and trails to support active and passive recreational pursuits of area residents.

The proposed amendment has been circulated internally for other departments’ comments.

Public Hearing:
A statutory public hearing is scheduled January 22, 2018, to be held prior to second reading. The public hearing has been advertised in the January 5 and January 12, 2018, editions of the Spruce Grove Examiner per requirements of the Municipal Government Act. A letter notifying about the public hearing was mailed to adjacent landowners and a notice was also posted on the City's website. 
If approved, the Land Use Bylaw map will be updated and posted on the City's website.
This amendment will provide for development of single-detached and semi-detached residential dwellings, a stormwater management facility, and a westward extension of the existing trail system.
