Request for Decision Summary
 This Request for Decision seeks Council’s second reading of Bylaw C-1015-17, an amendment to the Land Use Bylaw to redistrict 8.69 hectares in the West Central Area Structure Plan from UR - Urban Reserve District to C2 – Vehicle Oriented Commercial District.

Administration supports the amendment.  This amendment will allow for future subdivision for the development of a commercial shopping centre.
 
 
Proposed Motion
That second reading be given to Bylaw C-1015-17 - Land Use Bylaw Amendment - Redistricting for Legacy Park Stage 4.

Background/Analysis
WSP, on behalf of the purchaser, has applied to redistrict 8.69 hectares located in the Southeast ¼ of Section 5, Township 53, Range 27, West of the 4th Meridian and Part of Road Plan 802 2789 (ref. Road Closure Bylaw C-1014-17) within the Legacy Park neighbourhood from UR – Urban Reserve to C2 – Vehicle Oriented Commercial District. 

The purchaser intends two (2) commercial parcels for a shopping centre development. 

Municipal Development Plan:
Your Bright Future, Municipal Development Plan, 2010 – 2020 (MDP) is the City’s primary planning document, and its Figure 8 – Future Land Use Map defines the subject lands for Vehicle Oriented Commercial land use.  This proposed redistricting amendment to C2 – Vehicle Oriented Commercial District conforms to the MDP.

West Central Area Structure Plan:
The current amended West Central Area Structure Plan (ASP) Bylaw C-610-06, adopted July 10, 2006, defines RETAIL / COMMERCIAL land use for the subject lands per its Exhibit 4 – Proposed Development Concept.  This proposed redistricting amendment to C2 – Vehicle Oriented Commercial District conforms to the ASP.  Note: A proposed replacement West Central ASP Bylaw C-1016-17 is currently awaiting approval through the Edmonton Metropolitan Region Board REF process. This replacement ASP defines the future land use for the proposed amendment area as Commercial, and as such the amendment also conforms to the replacement ASP.

Land Use Bylaw:
The subject lands are currently districted UR – Urban Reserve in the Land Use Bylaw (C-824-12), and reclassification to an appropriate land use district is typical before subdivision and development.  This Land Use Bylaw Amendment proposes a change to the C2 – Vehicle Oriented Commercial District, which is a district intended to provide for the development of commercial uses serving vehicle traffic on sites adjacent to arterial roads, Highway 16 and Highway 16A. The C2 District would allow Retail Sales, Retail, Major and other typical shopping centre type developments and is otherwise consistent with the MDP and West Central ASP.

The proposed amendment was circulated internally for other City departments' comment.

Public Hearing:
A statutory public hearing was held on January 22, 2018, prior to this second reading.  The public hearing was advertised in the January 5 and January 12, 2018 editions of the Spruce Grove Examiner per the requirements of the Municipal Government Act. A notification of the public hearing was mailed to adjacent landowners, and a notice was also posted on the City's website.
Implementation/Communication
If approved, the Land Use Bylaw map will be updated and posted on the City's website.
Impacts
Approval of this Bylaw will allow the fourth stage of development in the Legacy Park neighbourhood to proceed.
