Request for Decision Summary
 
The purpose of this Request for Decision is to seek Council's consideration of first reading for Bylaw C-1025-17, the 2017 Land Use Bylaw Annual Review Amendments.  This Bylaw is the annual update of Land Use Bylaw C-824-12 which is undertaken to correct errors and omissions and to provide clarity to existing definitions and regulations.

That first reading be given to Bylaw C-1025-17 - 2017 Land Use Bylaw Annual Review Amendments.
Background/Analysis
Land Use Bylaw C-824-12 was adopted in late 2012 and implemented on January 1, 2013.  In order to provide a high quality regulatory document, the Planning and Development Department undertakes an annual review of the Bylaw.  This review does not propose to make major changes to the regulations; the purpose of this update is to fine tune definitions and regulations, provide enhanced clarity and fix inconsistencies.  

Information was gathered over the past year from Planning Staff and the development and building industries and is now considered for potential amendment to the Bylaw.  This is the fifth annual update to the Land Use Bylaw.

The attached chart entitled "Land Use Bylaw C-824-12 Annual Review, 2017 Proposed Amendments" itemizes all of the proposed amendments as well as provides the rationale for each proposed change.  The nature of most of the proposed amendments is to provide clarity to existing definitions and regulations, to provide for consistent regulations, and to add potential development permit conditions.

Consultation/Engagement
The proposed amendments were collected through 2017 from Administration and the development industry and have been circulated to Planning for feedback and issue resolution.

The Spruce Grove Chapter of the Urban Development Institute and the Canadian Home Builders' Association will be consulted and notified of the Public Hearing.  Notice of the public hearing will also be placed in the Spruce Grove Examiner.

 
Implementation/Communication
Upon third reading of the Bylaw, the amendments will be consolidated into Land Use Bylaw C-824-12 and posted on the City's website.
Impacts
The amendments will enhance and clarify the definitions and regulations to allow the development community and staff to better utilize the City's Land Use Bylaw.  This, in turn, allows Administration to provide more efficient and effective customer service.
